Trademark / Licensing Question – Derivative Works

by Tali.
Hi,

In additional to traditional jewelry, I make what I call “geek chic” jewelry, inspired by my favorite tv shows, films, comics etc.

I’m looking into starting to sell them besides using them as gifts for my friends, but I haven’t been able to find any information about derivative works with regards to trademarked items that says that’s okay.

Of course I see examples of these kinds of things all over Etsy.

And at jewelry and bead shows I’ve seen examples as well, lots of Disney items for example.

But I was thinking about possible branching out into comic books stores as well, because they are seriously lacking these kinds of items.

My concern here is if there is a penalty for selling derivative works and what constitutes selling an unlicensed trademark item.

I was wondering if there was any advice you had or resources you were aware of with regards to this issue.
Thank you!

Tali
